These Terms of Service ("Terms") govern your access to and use of Gamifans, including our website, mobile application, chat features, profiles, groups, posts, photos, videos, stories, notifications, and related services (collectively, the "Service").

Gamifans ("Gamifans," "we," "us," or "our") is operated from Passaic, New Jersey, United States. You can contact us at support@gamifans.com.

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 13 years old to use Gamifans. If you are under the age of majority where you live, you may use the Service only with permission from your parent or legal guardian.

You may not use the Service if you are prohibited from doing so under applicable law or if we previously suspended or terminated your account for violating these Terms, unless we give you written permission.

2. Your Account

You are responsible for your account and for all activity that occurs under it. You agree to:

• Provide accurate information when creating or updating your account.
• Keep your login credentials secure.
• Not share your password or allow others to access your account.
• Notify us promptly if you believe your account has been compromised.
• Not create fake, misleading, duplicate, automated, or abusive accounts.

We may suspend, restrict, or terminate accounts that violate these Terms or create risk for Gamifans, other users, or the public.

3. Description of the Service

Gamifans is a social platform that may allow users to create profiles, post and share photos and videos, publish stories, send messages, join groups, react to content, comment, follow or connect with other users, receive notifications, report content, and block users.

We may add, change, suspend, or remove features at any time. We do not guarantee that any feature will always be available or work without interruption.

4. No Payments at This Time

Gamifans does not currently offer paid subscriptions, in-app purchases, credits, paid messaging, paid content, or payment processing through the Service.

If we add paid features in the future, we will update these Terms and provide clear pricing and payment terms before any purchase is made.

5. User Content

"User Content" means any content you create, upload, post, send, store, display, or share through the Service, including text, photos, videos, stories, messages, comments, reactions, profile information, group content, and attachments.

You keep ownership of your User Content. By using the Service, you grant Gamifans a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, transmit, display, distribute, modify for technical formatting, and otherwise use your User Content only as needed to operate, provide, secure, moderate, improve, and promote the Service.

This license ends when your User Content is deleted from the Service, except that copies may remain in backups, logs, moderation records, legal records, content shared with other users, or other places where continued retention is permitted by law or necessary for legitimate operational purposes.

You represent and warrant that:

• You own or have the rights needed to share your User Content.
• Your User Content does not violate these Terms, our Community Guidelines, any law, or any rights of another person.
• Your User Content does not infringe copyright, trademark, privacy, publicity, or other rights.

6. Prohibited Conduct

You agree not to use Gamifans to:

• Harass, bully, threaten, intimidate, abuse, stalk, exploit, or harm others.
• Post or send hate speech, discriminatory content, or content attacking people based on protected characteristics.
• Share violent threats, instructions for violence, graphic abuse, or content glorifying serious harm.
• Share sexually exploitative content, child sexual abuse material, sexual content involving minors, or any content that sexualizes minors.
• Post pornography or use Gamifans primarily for sexual solicitation, prostitution, trafficking, or exploitation.
• Share private or confidential information about another person without permission, including addresses, phone numbers, login credentials, financial information, or identification documents.
• Impersonate another person, brand, company, public figure, or Gamifans representative.
• Send spam, scams, phishing, mass unsolicited messages, fake engagement, or deceptive promotions.
• Upload malware, viruses, harmful code, spyware, or links intended to compromise accounts or devices.
• Sell, advertise, or facilitate illegal or regulated goods or services, including illegal drugs, weapons, stolen goods, fake documents, or illegal gambling.
• Violate intellectual property rights or remove copyright notices.
• Scrape, harvest, crawl, copy, index, or extract data from the Service without permission.
• Reverse engineer, interfere with, overload, damage, or disrupt the Service.
• Create accounts or use automation to evade bans, rate limits, moderation, or security measures.
• Encourage or help others violate these Terms.

7. Community Guidelines

Our Community Guidelines are part of these Terms. You must follow them whenever you use Gamifans. We may remove content or restrict accounts that violate the Community Guidelines, even if the content is not listed word-for-word in these Terms.

8. Reports, Blocking, and Moderation

Gamifans may provide tools to report content, report users, block users, and manage safety. You agree not to abuse these tools by submitting false, malicious, or spam reports.

We may review content, accounts, messages, groups, reports, and activity to enforce these Terms, protect users, comply with law, and maintain the Service. We may take action at our discretion, including:

• Removing or limiting content.
• Adding warnings or visibility restrictions.
• Disabling features.
• Suspending or terminating accounts.
• Preserving information for safety, legal, or enforcement reasons.
• Reporting illegal conduct to authorities where appropriate.

We are not obligated to monitor all content, and we do not guarantee that all objectionable content will be removed immediately. Users are responsible for their own actions and content.

9. Intellectual Property of Gamifans

Gamifans, including its name, logos, design, software, features, graphics, and other materials, is owned by Gamifans or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service unless we give you written permission or the law allows it.

10. Copyright Complaints

We respect intellectual property rights. If you believe content on Gamifans infringes your copyright, you may submit a notice under our DMCA and Copyright Policy. We may remove or disable access to allegedly infringing content and may terminate repeat infringers.

11. Privacy

Our Privacy Policy explains how we collect, use, share, and protect information. By using the Service, you agree that we may handle information as described in the Privacy Policy.

12. Third-Party Services

The Service may contain links, integrations, or content from third parties. We are not responsible for third-party websites, services, content, policies, or practices. Your use of third-party services is at your own risk and may be governed by separate terms and policies.

13. Termination

You may stop using Gamifans at any time. You may request deletion of your account through the Service, at https://www.gamifans.com/account-deletion if available, or by contacting support@gamifans.com.

We may suspend, restrict, or terminate your account or access to the Service at any time if we believe you violated these Terms, created risk, caused harm, violated law, or used the Service in a way that may expose Gamifans or others to liability.

After termination, these Terms will continue to apply where necessary, including sections about User Content, intellectual property, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution.

14. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, Gamifans disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, security, accuracy, and reliability.

We do not guarantee that the Service will be uninterrupted, error-free, secure, free of harmful components, or that user content will be accurate, safe, or available.

15. Limitation of Liability

To the maximum extent permitted by law, Gamifans and its owners, operators, affiliates, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost goodwill, service interruption, device damage, or user disputes.

To the maximum extent permitted by law, Gamifans' total liability for any claim related to the Service will not exceed one hundred U.S. dollars (US $100) or the amount you paid to Gamifans in the twelve months before the claim, whichever is greater. Because Gamifans does not currently offer paid services, this limitation will generally be US $100 where permitted by law.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

16. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Gamifans and its owners, operators, affiliates, service providers, and representatives from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to:

• Your use of the Service.
• Your User Content.
• Your violation of these Terms or our policies.
• Your violation of law or rights of another person.
• Your misuse of another user's information or content.

17. Changes to the Service or Terms

We may update the Service and these Terms from time to time. When we update these Terms, we will change the "Last updated" date above. If changes are material, we may provide additional notice as appropriate. Your continued use of the Service after changes become effective means you accept the updated Terms.

18. Governing Law and Venue

These Terms are governed by the laws of the State of New Jersey and applicable federal laws of the United States, without regard to conflict-of-law rules, except where applicable law requires otherwise.

To the extent a dispute is not required to be handled in another forum by applicable law, you and Gamifans agree that disputes arising from or relating to these Terms or the Service may be brought in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts.
